ABOUT THE INSTRUCTOR:
Scott Sliker brings an exclusive set of experiences to share with attendees. After two decades as a NYS Sales Tax Field Audit Specialist, he founded The Sales Tax Professionals and has been helping manufacturers comply with the ever changing and complicated world of New York State Sales Tax for over 15 years.

Content Overview:

● An interactive discussion of terms & taxability of manufacturers’ purchases of goods & services.
Review the rules on taxing the following purchases by manufacturers: raw materials; production machinery and equipment; on-site assembly; installation and maintenance; quality control; utilities (fuel, gas, electricity); packaging and containers; and common services including computer consulting, transportation, information services, storage, protective and detective services, and telecommunications.

Review proper treatment of research and development costs, safety equipment and supplies, the use of self-manufactured products, and the taxation of temporary service agency employees.

● Exemption certificates, direct pay permits, IDA letters, & QEZEs.
There are over 50 sales and use tax forms issued by the New York State Department of Taxation. Learn which forms you need to file, as well as how to prepare returns according to Department guidelines. This session will also detail the rules for exemption certificates, certificates of capital improvement, direct pay permits, IDA letters, and QEZE certificates.

● Capital improvements, contractors & construction projects
Whether you are building an addition onto an existing structure or maintaining the physical plant you already have, sales and use taxes will impact every expenditure. Learn where to draw the line between an exempt “capital improvement” and a taxable “repair or maintenance” of your property. Also learn what rules are applicable to construction contractors and how they impact your customers.

● E-commerce & corporate purchasing cards
Learn what you must know about the rapidly changing issues of e-commerce and concerns surrounding charges

● What’s new
Review changes in law and regulations, and discuss any current court rulings or administrative decisions that may affect manufacturers.

● Interstate sales & purchases
Your company probably buys or sells goods or services from outside New York State.

Learn how New York taxes these transactions, and understand how other states may attempt to impose tax on your sales in their jurisdictions.

Learn both “lore” and “law” as actually applied by manufacturers doing business across state lines.

● Why am I being audited?
This question has been asked at every seminar. Get the inside story from those who know…former New York State auditors!

● Handling the audit
Learn how taxpayers may be selected for audit, how to respond to an audit letter, and what work papers and company records you should (and shouldn’t) have available.

Learn when to arrange for a “reverse audit” to identify overpayments of tax (to offset the auditors findings of under payments), how to handle the audit conference and pre-assessment negotiations, and how to manage the administrative and legal tangle that follows an audit assessment.
